Terms and Conditions

These terms govern the use of kylescope as a marketplace for AI tools, workflows, automations, analytics products, and related human support services.

By creating an account, placing an order, subscribing, uploading files, or continuing to use the platform, a user acknowledges these terms and policies as part of the service relationship, subject to any non-waivable rights that apply under local law.

Marketplace use

Users must provide accurate information, maintain the security of their credentials, and comply with applicable law.
Listings, pricing, product availability, service scope, and promotional content may change over time and should not be treated as legal, tax, or professional advice.
kylescope may suspend, limit, or terminate accounts, uploads, orders, or subscriptions that abuse the service, violate law, create platform risk, or expose the company to avoidable liability.
Use of the platform is licensed, limited, revocable, and non-exclusive. No user or business acquires ownership in the platform, prompts, software, delivery methods, internal processes, or unpublished materials by using the service.

Website monitoring and analytics

The platform may monitor usage of the website and marketplace, including page views, browsing paths, approximate location indicators, device and browser characteristics, engagement timing, and related technical signals for operational, security, analytics, and commercial purposes.
Such monitoring may be used to improve user experience, optimize conversions, measure SEO and marketing performance, detect abuse, and manage customer, writer, or order workflows through the admin dashboard.
Use of the website remains subject to the Privacy Policy and Cookie Policy, and additional consent mechanisms may be introduced where legally required.

User responsibility and business reliance

Users and client businesses remain responsible for reviewing outputs, verifying facts, testing workflows, checking compliance, and determining whether any tool output, service deliverable, or recommendation is suitable for their intended use.
No content on the platform is guaranteed to be complete, accurate, error-free, lawful in every jurisdiction, fit for a specific commercial purpose, or free from third-party dependency issues.
By proceeding with the platform, a user or business acknowledges that they are using the service at their own commercial discretion and not in reliance on any warranty of uninterrupted, risk-free, or litigation-free operation.

Billing and subscriptions

Each AI tool may have its own monthly subscription amount, billing interval, access level, and renewal configuration.
Payment processing, renewals, cancellations, charge review, and disputes may be subject to PayPal terms and any additional merchant-specific policies.
Quote-based services may require staged payment, including an upfront amount before work begins and a remaining balance on completion, unless the company agrees to a different scope arrangement.
Before launch or region expansion, refund rules, renewal disclosures, tax handling, and local consumer notices should remain aligned with actual product behavior and applicable law.

Limitation of liability

The service is provided on an as-available basis subject to maintenance, provider outages, third-party platform dependencies, moderation controls, and business review processes.
To the maximum extent permitted by law, kylescope, Staunch Business Technologies, their operators, affiliates, personnel, contractors, licensors, and suppliers are not liable for indirect, incidental, special, consequential, punitive, reputational, lost-profit, lost-data, lost-opportunity, or business interruption damages arising from or related to the platform, services, outputs, delays, third-party failures, user misuse, or unauthorized access.
To the maximum extent permitted by law, any aggregate liability relating to a paid service or subscription should be limited to the amount actually paid by the affected user for the relevant service during the shortest period required by applicable law, unless mandatory law requires otherwise.
Nothing in these terms is intended to override mandatory consumer, data-protection, or non-excludable statutory rights.

Indemnity and dispute framework

Users and client businesses agree, to the maximum extent permitted by law, to defend, indemnify, and hold harmless kylescope, Staunch Business Technologies, and related parties from third-party claims, losses, liabilities, costs, and expenses arising from their instructions, content, files, misuse of outputs, unlawful conduct, infringement, or breach of these terms.
Any dispute should first be raised through the platform support or admin channel so the parties have a fair opportunity to resolve the matter informally before escalation.
A governing-law, venue, arbitration, class-action waiver, and cross-border enforcement framework should be finalized with jurisdiction-specific legal review before large-scale launch, and until then any unenforceable clause should be read down rather than voiding the remaining terms.
